Introduction
Welcome to We Buy Houses National ("WBHNat"). Using the services
available on www.webuyhousesnational.com
("the site") you ("the User") are agreeing to the following
terms and conditions, without modification, contained within
these Terms of Use ("Agreement").
Before you submit a property to WBHNat, we ask that you please
thoroughly and carefully read and accept all of the terms of
this Terms of Use and conditions in our Privacy
Policy. By accepting this Agreement, you also agree that
your use of any other linked third party branded web sites will
be governed by any and all User Agreement(s) and Privacy Policies
posted on those web sites.
Using We Buy Houses National
Overview:
The Sites and the services offered within are provided exclusively
as an environment and specialized crossing point that connects
property owners with WBHNat Affiliates ("Affiliates"), licensed
investors, real estate agents, brokers and/or other real estate
related service providers ("the providers"). We do not provide
any real estate, appraisal or real estate related services,
and do not hold ourselves out as being licensed to perform any
such services. We do not subsidize, approve, advocate or endorse
of any of the providers who offers services and or information
through the Site. You should use your sovereign conclusion of
the intrinsic worth of any individual, entity or information
that you find on or through the Site. While we try to confirm
that participating investors, real estate agents, brokers and
other home-related service providers are licensed to perform
their respective services, we cannot and do not represent or
warrant that any real estate agent, broker or other home-related
service provider who offers services through the Sites is licensed,
qualified, or capable of performing any such service.
It should also be noted that we do not make any assurance as
to the timeliness or accuracy of information provided by any
investor, real estate agent, broker or other home-related service
provider including any home evaluation, or other related follow
up. Furthermore, if the requesting property owner submits incomplete,
insufficient or inaccurate information, or is in conflict with
real estate rules, laws or best practices, then our service
may not be provided to the requesting property owner. WBHNat
is not responsible for any inaccurate information provided by
Property Owners ("Sellers"), however there are cases where restitution
will be made for bad leads. See our Refund/Credit Policy Below.
While using the Web Site, Users are welcome to:
- Browse and view our entire Web Site (webuyhousesnational.com)
- Submit a property that either you own or are legally authorized
to submit;
- Send any comments, complaints, feedback, or questions to
support@webuyhousesnational.com;
While using the Web Site, Users will not:
- Post fictitious information on the Site;
- Violate any laws, third party rights, or our policies;
- Use the Web Site if you are not able or legally authorized
to form legally binding contracts, are under the age of 18,
or are restricted from using the Web Site;
- Post false, inaccurate, misleading, defamatory, or libelous
content (including personal information);
- Distribute or post spam, chain letters, or pyramid schemes;
- Distribute viruses or any other technologies that may harm
WBHNat, or the interests or property of WBHNat users;
- Copy, modify, or distribute content from the Web Site and
WBHNat's copyrights and trademarks;
- Harvest or otherwise collect information about the web site,
including copying text, images, without our direct written
consent.
Termination
We may terminate or suspend your access to the web site at
any time, with or without cause, or notice. Upon such termination
or suspension, your right to use the web site will immediately
cease.
If you would like to terminate your account at any time, please
send written notification to WBHNat, Attn: Customer Service
Dept., 6175 NW 167th Street, #G-25, Miami, Florida, 33015 or
to support@webuyhousesnational.com.
The request for termination must include and/or be from the
email address the account is under.
Fees and Services
Submitting a property on the site is free. WBHNat offers a
free service in which our technology connects property owners
interested in receiving a cash offer on a property from a registered
WBHNat Affiliate Buyer. We are not a Real Estate Brokerage.
We do not list property. We do not guarantee a cash offer.
User names and Passwords
A username and/or password may be issued to you by WBHNat
to access certain segments of www.webuyhousesnational.com.
In order to receive a username and/or password from WBHNat for
use on www.webuyhousesnational.com,
you will be required to submit personally identifiable information.
You are responsible for keeping your usernames and passwords,
if any, confidential. You are responsible for any access, use
or activities on www.webuyhousesnational.com
conducted with your login credentials.
Refund/Credit Policy
Our 100% Lead Satisfaction Guarantee policy allows you to
return any lead for any reason within 24 hours for another lead.
WBHNat reserves the right to either credit your account or replace
with another lead.
To cancel Area Lead Exclusivity (ALE) please read the header
ALE below.
Lead Sales
After you have registered as a WBHNat Investor, WBHNat will
email you Free Lead Notification made through the web site in
accordance with the criteria of this Terms of Use, WBHNat general
Terms of Use located on the Seller side of our site, and our
privacy policy. WBHNat will not be responsible for any email
delays or receptivity problems to the Investors registered email
address. Should you feel you have a problem please check your
mail settings and/or your SPAM folder or contact us at support@webuyhousesnational.com.
The Investor agrees not to distribute or re-sell to any third
party, without express written permission from WBHNat. The Investor
should contact the Seller and use the Leas only for the purposes
directly related to the Lead.
The Seller is not disallowed from contacting Investors outside
of WBHNat. WBHNat can not guarantee that another Investor will
make an offer on the Seller property. We can guarantee that
our Lead was sold to one Investor.
WBHNat will not offer Seller information purchased by one
Investor to other Investors. Each lead will be sold only once.
WBHNat may sell Seller information purchased by one Investor
to another source, such as a Home Improvements provider or industry
related source.
Cash Buyer Solicitation
WBHNat solicits an "All Cash, Any Price, Quick Close" offer
on our website. Please advise Seller if you can not comply.
WBHNat is a portal connecting Property Sellers with Investors,
we are not the Cash Buyer, once you purchase a lead, you are
the potential Buyer.
Area Lead Exclusivity (ALE)
WBHNat offers our Investors the right to a 24-hour period
of exclusivity on each new Lead in an Area where ALE is held.
Investors with Area Lead Exclusivity will receive notification
of new leads 24 hours prior to other Investors registered in
the same Area. Currently, only one Investor may hold ALE in
any one Area. Once you purchase ALE, as long as you continue
to purchase renewals of ALE, you will continue to have exclusive
rights.
In the event that our supply of leads exceeds what we feel
one investor may purchase, we reserve the right to add multiple
ALE Investors to any given market with no notice.
Buying ALE does not guarantee any volume of leads; it only
guarantees exclusive free lead notification, with a 24 hour
expiration date on exclusivity. ALE does not include the price
of buying a lead. All offered leads to ALE Investors must still
be purchased at our regular stated lead price. ALE is not a
subscription and the ALE term is paid for up front with no recurring
charges.
Cancel ALE: Our Area Lead Exclusivity (ALE) is priced in 30,
60, and 90 day periods. Should you wish to cancel your term
of ALE, simply send an email to support@webuyhousesnational.com
and we will prorate your account with any balance greater then
14 days. For example, if you buy a 30 day ALE and in 6 days
you decide to cancel we will credit you the pro-rated value
of 10-days ALE.
Using WBHNat Name & Logo (Verbal and Written)
As a registered WBHNat Investor you are allowed to use the
trade name "We Buy Houses National" for the purposes of introducing
yourself to any Seller from information you purchased from WBHNat.
WBHNat disallows any Investor to suggest that it is acting on
behalf of WBHNat.
An example would be the following: "Hello, Mr. Jones, My name
is Fred, I was referred to you by We Buy Houses National, the
website you submitted your information to about selling your
home."
Unless otherwise approved by management, you are not allowed
to use any graphics or text, including logo and screen shots
of our website to solicit any "leads" from prospective Sellers.
WBHNat is a Conduit
WBHNat is a conduit for Property Sellers and Property Investors/Buyers.
WBHNat is not involved in any actual transactions between any
Seller and Investor through the entire site. WBHNat has no control
nor can guarantee that any user is qualified to submit, propose,
quote, offer or sell.
Once the sale of a Property Lead is complete, We Buy Houses
National plays no role other than future access to the Lead
information. We do not have any interaction in the scope of
a Real Estate transaction.
Discrimination
WBHNat complies with all applicable laws and shall not discriminate
on the grounds of race, color, religion, sex, national origin,
citizenship status, age, disability, or veteran's status in
employment, education, and all other areas.
Limitation of Liability
Under no circumstances will WBHNat or its agents be liable
for any damages caused by any User of the site.
Agency
No agency, partnership, joint venture, employee-employer or
franchiser-franchisee relationship is intended or created by
this Agreement.
Copyright and Trademark
All materials on the WBHNat Web Site (as well as the organization
and layout of any sub domain Web Sites) are owned and copyrighted
or licensed by We Buy Houses National, Inc., its affiliates
or its suppliers.
Trademarks referenced on the WBHNat Web Site, including National
Affiliate Buyer™, but not limited to, are either trademarks
or registered trademarks of We Buy Houses National, Inc.
Use by Minors
www.webuyhousesnational.com
is not intended to be accessed or utilized by persons under
the age of 18.
Amendments of this Agreement
WBHNat reserves the right to change, amend, or modify any of
this Agreement, at any time, in its sole discretion and without
notice. Changes, revisions or deletions with regard to this
Agreement shall be effective immediately upon their inclusion
in, or deletion from, this Agreement, and the posting of the
same in this Agreement, we will post a new version on the site
and update the effective date, on www.webuyhousesnational.com.
You are encouraged to revisit this Agreement from time to time
in order to review any changes that have been made. Your continued
access and use of www.webuyhousesnational.com
following the posting of any such changes shall automatically
be deemed your acceptance of the same.
